CHAP. 179.— AN ACT To authorize the city of Seattle, Washington, to purchase certain lands for the protection of the source of its water supply. February 28, 1911.[[S. 5432](/us/bill/36/s/5432).][[Public, No. 431](/us/bill/36/pl/431).] *Be it enacted by the Senate and House of Representatives of the United States of America in. Congress assembled*, That the public lands Public lands.in township twenty-one north, ranges nine, ten, and eleven east, and township twenty-two north, ranges eight, nine, ten, and eleven east of the Willamette meridian, in the State of WashingtonLands withdrawn from entry in Washington., are hereby withdrawn from all location, settlement, and entry under the public-land laws: *Provided,* *Proviso.*That this withdrawal shall in no way operate to Interfere with the right of any settler or other claimant Valid rights not affected.under the publicland laws to complete a claim to any portion of such land heretofore lawfully initiated.
Sec.2.That upon the deposit, within one year of the passage Cedar River, Wash., drainage basin.of this Act, by the city of Seattle, Survey authorized for Seattle.in the State of Washington, with the Secretary of the Interior, of a sum estimated by him as sufficient to pay the cost of the survey herein provided for, the said Secretary shall cause to be executed a survey, defining the limits of the drainage basin of Cedar River within the area withdrawn by section one of this Act and pay for the same out of the appropriation for public-land surveys, and a sum sufficient to pay the cost of such survey shall be paid into the Treasury of the United States, to the credit of the appropriation for public-land surveys, out of the sum so deposited by the city of Seattle, and the remainder of the sum so deposited, if any, shall be repaid to such city, and upon the completion of such survey and its approval by the Secretary of the Interior the lands withdrawn by section one of this Act not within the. drainage basin of Cedar River shall be restored to their present status.
Sec.3.That upon the deposit with the Secretary of the Interior Appraisal of lands, etc.within one year of the passage of this Act, by the city of Seattle, State of Washington, of a sum estimated by the Secretary of the Interior to be sufficient to cover the cost of the examination and appraisal Appraisers to be designated.herein provided for, the Secretary of the Interior and the Secretary of Agriculture shall each designate one qualified appraiser, and the two appraisers thus designated shall designate a third appraiser, who shall be a resident of King County, Washington, not a Federal officer or employee, who shall be familiar with the stumpage value of 960timber in the locality to be appraised, and the board of appraisers thus constituted shall proceed to an examination and appraisal of the present commercial stumpage value of the timber on the public lands within the drainage basin of Cedar River in the area withdrawn by section one of this Act, the cost of such examination and appraisal to be paid out of the appropriation for public-land surveys.
Upon the completionPayment of expenses by Seattle.of such examination and appraisal and its approval by the Secretary of the Interior and the Secretary of Agriculture a sum sufficient to pay the cost thereof shall be paid into the Treasury of the United States, to the credit of the appropriat ion for public-land surveys, out of the sum deposited therefor by the city of Seattle, and the remainder of such sum, if any, shall be repaid to said city. Sec.4.That within one year after the approval of the survey Seattle, Wash.and appraisal provided for in this Act, the Secretary of the Interior is authorized to patent to the city of Seattle all of the public lands Lands in drainage basin granted to.within the drainage basin of Cedar River in the area withdrawn under section one of this Act, upon the payment Payment.by the said city of Seattle of the sum estimated by the board of appraisers provided for in section two of this Act as being the present commercial stumpage value of the timber on the public lands within such area: *Provided,* *Provisos.*That if the sum of such estimate shall be less than the sum of one dollar and twenty-five cents per acre for all of the lands Minimum price.to be patented the city of Seattle shall pay the sum of one dollar and twenty-live cents per acre for said lands: *And provided further,* That there is herebyMinerals reserved.reserved to the United States all mineral deposits in said lands and the right to dispose thereof and to use such lanas for such purpose.
