CHAP. 148.— AN ACT Amending an Act entitled “An Act to amend an Act to provide the times and places for holding terms of the United States court in the States of Idaho and Wyoming,” approved June first, eighteen hundred and ninety-eight. February 23, 1911.[[S. 3315](/us/bill/36/s/3315).][[Public, No. 410](/us/bill/36/pl/410).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That section three ofIdaho judicial district.“An Act to provide the times and places for holding terms of the United States courts in the States of Idaho and Wyoming,”Vol. 27, p.72.approved July fifth, eighteen hundred and ninety-two, as amended by the amendatory ActVol. 30, p, 423.approved June first, eighteen hundred and ninety-eight, be amended Post, p.1109.so as to read as follows:
“Sec.3.That for the purpose of holding terms of the district court said district shall be divided Divisions of district.into four divisions, to be known as the northern, central, southern, and eastern divisions.Vol. 30, p. 423, amended.The territory embraced on the first day of July, nineteen hundred and ten, in the counties of Shoshone, Kootenai, and Bonner shall constitute the northern divisionNorthern.of said district; and the territory embraced on the date last mentioned in the counties of Latah, Nez Perce, and Idaho shall constitute the central division Central.of said district; and the territorySouthern. embraced on the date last mentioned in the counties of Ada, Boise, Blaine, Cassia, Twin Falls, Canyon, Elmore, Lincoln, Owyhee, and Washington shall constitute the southern division of said district;
Eastern.and the territory embraced on the date last mentioned in the counties of Bingham, Bear Lake, Custer, Fremont, Bannock, Lemhi, and Oneida shall constitute the eastern division of said district.” Sec.2.That section six of said Act Terms.as amended by the Act approved June first, eighteen hundred and ninety-eight, be amended so as to read as follows:Vol. 30, p. 424, amended. “Sec.6.That the terms of the district court for the northern division of the State of Idaho shall be held at Coeur d’Alene City Coeur d’Alene City.on the fourth Monday in May and the third Monday in November; for the central division, at Moscow Moscow.on the second Monday in May and the first Monday in November; for the southern division, at Boise CityBoise City.on the second Mondays in February and September; and for the eastern division, at Pocatello Pocatello.on the second Mondays in March and October; and the provision of any statute now existing providing for the holding of said terms on any day contrary to this Act is hereby repealed;
Transfer of pending suits, etc.and all suits, prosecutions, process, recognizance, bail bonds, and other things pending in or returnable to said court are hereby transferred to, and shall be made returnable to, and have force in the said respective terms in this Act provided in the same manner and with the same effect as they would have had had said existing statute not been passed. “That the clerk Offices of clerk, etc.of the district and circuit courts for the district of Idaho and the marshal and district attorney for said district shall perform the duties appertaining to their offices, respectively, for said courts of the said several divisions of said judicial district.
Whenever Deputy clerk at Coeur d’Alene City.in the judgment of the district and circuit judges the business of said courts hereafter shall warrant the employment of a deputy clerk at Coeur d’Alene City, new books and records may be opened for the said court, and a deputy clerk appointed to reside and keep his office at Coeur d’Alene City.” Approved, February 23, 1911.
