CHAP. 225.— An Act To promote the safety of employees on railroads. May 30, 1908.[[H. R. 19795.]](/us/bill/70/hr/19795)[[Public, No. 165.]](/us/pl/70/165) *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That on and after the firstLocomotive ash pan. day of January, nineteen hundred and ten. it shall be unlawful for any common carrier engaged in interstate or foreign commerce by railroadEngines to be equipped with safety pans. to use any locomotive in moving interstate or foreign traffic, not equipped with an ash pan, which can be dumped or emptied and cleaned without the necessity of any employee going under such locomotive.
Sec. 2. That on and after the first day of January, nineteen hundredUse of locomotives not equipped with, forbidden. and ten, it shall be unlawful for any common carrier by railroad in any Territory of the United States or the District of Columbia to use any locomotive not equipped with an ash pan, which can be dumped or emptied and cleaned without the necessity of any employee going under such locomotive. Sec. 3. That any such common carrier using any locomotive in violationPenalty for violation. of any of the provisions of this Act shall be liable to a penalty of two hundred dollars for each and every such violation, to be recovered in a suit or suits to be brought by the United States district attorney in the district court of the United States having jurisdiction in theSuite. locality where such violation shall have been committed; and it shall be the duty of such district attorney to bring such suits upon duly verified information being lodged with him of such violation havingInformation. occurred; and it shall also be the duty of the Interstate Commerce Commission to lodge with the proper district attorneys information of any such violations as may come to its knowledge.
Sec. 4. That it shall be the duty of the Interstate Commerce CommissionInterstate Commerce Commission to enforce act. to enforce the provisions of t his Act. and all powers heretofore granted to said Commission are hereby extended to it for the purpose of the enforcement of this Act. Sec. 5. That the term “common carrier” as used in this Act shallReceivers, etc., included in term “common carrier.” include the receiver or receivers or other persons or corporations charged with the duty of the management and operation of the business of a common carrier.
Sec. 6. That nothing in this Act contained shall apply to any locomotiveException. upon which, by reason of the use of oil. electricity, or other such agency, an ash pan is not necessary. Approved, May 30, 1908.
