CHAP. 162.— An Act To provide for circuit and district courts of the United States at Gadsden, Alabama. February 19, 1909.[[H. R. 21560](/us/bill/70/hr/21560).][[Pubic, No. 247.](/us/pl/70/247)] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That the middle division of theAlabama northern judicial district.Middle division created.R. S, 532, p. 89. northern judicial district of the State of Alabama is hereby established, composed of the counties of Cherokee, Dekalb, Marshall, Etowah, and Saint Clair.
Sec. 2. That a term of the circuit and the district courts of theTerms at Gadsden.R. S, secs. 572, 658, pp. 98, 120. middle division of the northern judicial district of the State of Alabama shall be held at Gadsden, in Etowah County, in said State, on the first Tuesday in February and on the first Tuesday in August of each year: *Provided, however*, That suitable rooms and accommodations*Proviso.*Cour rooms. are furnished for the holdings of said courts, free of all expense to the Government, until a public building shall be provided for by law. 641 Sec. 3.
That all civil process issued against persons residing in saidReturn of process. counties cognizable before the United States court shall be made returnable to the courts of the United States, respectively, to be held at Gadsden, as provided by this Act, and all prosecutions for offenses committed in any of said counties shall be tried in the appropriate United States court at Gadsden: *Provided*, That no process or prosecutions*Proviso.*Pendng cases not affected. commenced or suits instituted before the passage of this Act shall be in any way affected by the provisions hereof, and that all prosecutions heretofore commenced for offenses heretofore committed against the United States in any of the said counties shall be prosecuted and tried as though this Act had not been passed.
Sec. 4. That it shall be the duty of the clerks, marshals, and otherAttendance of clerks, etc. officers of the northern judicial district to attend said. terms of said court and perform the duties pertaining to their positions, and no additional clerk or marshal shall be appointed in said district; and that the clerks of the circuit and district courts of said northern district shall maintain an office, in charge of themselves or a deputy, at Gadsden, which shall be kept open at all times for the transaction of the business of said division.
