CHAP. 3907.— An Act For the relief of James H. Oliver, a commander on the retired list of the United States Navy. June 30, 1906. [[S. 1864](/us/bill/59/s/1864).] [[Public, No. 376](/us/pl/59/376).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, Navy. James H. Oliver. Appointment as commander on active list, authorized. *Provisos*. Examination. That the President be, and he is hereby, authorized to appoint James H.
Oliver, now a commander on the retired list of the United States Navy, to the grade of commander on the active list of the United States Navy: *Provided*, That the said James H. Oliver shall establish to the satisfaction of the Secretary of the Navy, by examination pursuant to law, his physical, 633 mental, moral, and professional fitness to perform the duties of that grade: *Provided further*, That the said James H. Oliver shall be carried Additional number of grade. as additional to the number of the grade to which he may be appointed under this Act or at any time thereafter promoted: *And provided further*, That said James H.
