CHAP. 2083.— An Act To provide for the extension of New Hampshire avenue, in the District of Columbia, and for other purposes. February 27, 1907. [[H. R. 23576](/us/bill/59/hr/23576).] [[Public, No. 143](/us/pl/59/143).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, District of Columbia.New Hampshire avenue.Condemning land for extending, to District line. That within ninety days after the passage of this Act the Commissioners of the District of Columbia be, and they are hereby, authorized and directed to institute in the supreme court of the District of Columbia, sitting as a district *Ante*, p. 151.court, under and in accordance with the provisions of subchapter one of chapter fifteen of the Code of Law for the District of Columbia, a proceeding in rem to condemn the land that may be necessary for the extension of New Hampshire avenue on a straight extension of the lines thereof, as now established in the city of Washington. from its present terminus north of Buchanan street to the District line, with a uniform width of one hundred and twenty feet.
Sec. 2. Assessment.*Ante*, p. 152. That assessments shall be made by the jury as benefits as contemplated in section four hundred and ninety-one g of the *Proviso*.Damages, etc., to be assessed as benefits.subchapter of the Code hereinbefore referred to: *Provided*, That the total amount found to be due and awarded as damages, plus the cost and expenses of the proceedings, shall be assessed by the said jury as benefits. Sec. 3. Appropriation for expenses. That the sum of six hundred dollars is hereby appropriated out of the revenues of the District of Columbia to provide the necessary funds for the costs and expenses of the condemnation proceedings taken pursuant hereto, to be repaid to the District of Columbia Repayment.from the assessments levied by the jury for benefits, when the same are collected.
