CHAP. 1367.— An Act Authorizing the Choctawhatchee Power Company to erect a dam in Dale County, Alabama. April 5, 1906. *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, Choctawhatchee River.Choctawhatchee Power Company may dam, near Newton. Ala. That the Choctawhatchee Power Company, its successors and assigns, be, and is hereby, authorized to erect, build, have, and maintain a steel and concrete dam, or dam of other material, on the Choctawhatchee River at a point above the Atlantic Coast Line Railroad bridge near Newton, on said river *Provisos.*Secretary of War to approve plans, etc.and in Dale County, Alabama: *Provided,* That the plans of said dam shall be submitted to and be approved by the Chief of Engineers and the Secretary of War before construction is commenced; and the Secretary of War may at any time require and enforce, at the expense of the owners, such modifications in the construction of said dam as he may deem advisable in the interests of navigation: *Provided further, *Sluiceway.That there shall be placed and maintained in connection with said dam a sluiceway so arranged as to permit logs, timber, and lumber to pass around, through, or over said dam without unreasonable delay or Fishways.hindrance and without toll or charges; and suitable fishways, to be approved by the United States Fish Commission, shall be constructed and maintained on said dam.
Sec. 2. Time of completion.That this Act shall be null and void unless the dam herein authorized is commenced within one year and completed within three years from the date hereof. Sec. 3. Amendment.That the right to amend or repeal this Act is hereby expressly reserved. Approved, April 5, 1906.
