CHAP. 1316.— An Act To indemnify G. W. Hardy and Joseph Lard, of Scott County, Mississippi, for homestead land by granting other lands in lieu thereof. March 2, 1905.[[S. 5245](/us/bill/58/s/5245).][[Private, No. 1182](/us/pvtl/58/1182).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That there is hereby grantedG. W. Hardy and Joseph Lard.Grant of lands in Mississippi to, in lieu of homestead lands. to G. W. Hardy and Joseph Lard, Scott County, Mississippi, each eighty acres of the unreserved public land of the United States in the State of Mississippi, such as they shall, respectively, select and notify to the Secretary of the Interior, in subdivisions not less than forty acres, the same to be in lieu of land held by them but awarded by the General Land Office to the Alabama and Vicksburg Railroad Company.
Sec. 2. That such selection shall not be made of any land lawfullyPrior rights not affected. held by any other person at the time of such selection as a homestead entry, or to which any other person shall have at such time any lawful claim. Sec. 3. That immediately upon the notification to the Secretary of the Interior it shall be the duty of the SecretaryPatents. of the Interior to immediately issue patent or patents, as the case may be, to said G. W. Hardy and Joseph Lard, respectively, for the lands so selected and notified.
Sec. 4. That this Act shall take effect and be in force from and afterEffect. its passage. Approved, March 2, 1905.
