CHAP. 1313.— An Act To authorize the board of supervisors of Berrien County, Michigan, to construct a bridge across the Saint Joseph River near its mouth in said county. March 2, 1905. [[H. R. 18728](/us/bill/58/hr/18728s).] [[Public, No. 133](/us/pl/58/133).] *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, * Saint Joseph River. Berrien County, Mich., may bridge. That the board of supervisors of Berrien County, in the State of Michigan, be, and are hereby, authorized to construct, maintain, and operate a bridge across the844 Saint Joseph River near its month in said Berrien County, at or nearLocation. the site of the bridge now known as Napier Bridge.
Sec. 2. That said bridge shall be located and built under and subjectSecretary of War to approve plans, etc. to such regulations for the security of navigation as the Secretary of War may prescribe; and to secure that object the said board of supervisors shall submit for his examination designs and drawings of the bridge and maps of the Location, and until the said plans and location are approved by him the bridge shall not be commenced or built; andChanges. should any changes be made in said bridge, before or after completion, such changes shall he likewise subject to the approval of the Secretary of War.
That the bridge shall be known and recognized as a postPost route. route, and shall enjoy the rights and privileges of other post-roads of the United States, and no charge shall be made for the transmission over the same of the mails, troops, and munitions of war of the United States. Equal privileges in the use of said bridge shall be granted toTelegraph, etc., rights. all telegraph and telephone companies, and the United States shall have the right of way across said bridge and its approaches for postal, telegraph, and telephone purposes.
Sec. 3. That the said bridge shall be so kept and managed as to offerUnobstructed navigation. reasonable and proper means for the passage of vessels and other craft through or under the same; and for the safety of vessels passing atLights, etc. night there shall be displayed on said bridge from sunset to sunrise, at the expense of the owners thereof, such lights or other signals as the Light-House, Board may prescribe. And any changes in said bridge which the Secretary of War may at any time deem necessary and order in the interests of navigation shall be made by the owners thereof at their own expense.
Sec. 4. That this Act shall be null and void if actual construction ofTime of construction. the said bridge be not commenced in one year and completed in three years from the date hereof. Sec. 5. That the right to alter, amend, or repeal this Act is herebyAmendment. expressly reserved. Approved, March 2, 1905.
