CHAP. 889.— An Act For the relief of Richard H. Townley, a lieutenant (junior grade) on the retired list of the United States Navy. March 3, 1901. Whereas Lieutenant Richard H. Townlev, United States Navy,Richard H. Townley. after seventeen years of active service, was placed upon the retired list of the Navy by reason of disability incurred through arduous service and excessive and prolonged exposure in the line of duty; and Whereas the said Richard H. Townley has entirely recovered from the said disability which caused his retirement and is able to perform active duty; and Whereas the said Richard H.
Townley volunteered for active duty and served continuously and creditably during the war with Spain; and Whereas several other officers who have been retired have been restored to and are now on the active list: Therefore that justice may be done the said Richard H. Townley, and that the Navy Department may be enabled to command his services for all and any duty to which he may be assigned, *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*, That the President be, andMay be appointed to active list of Navy. hereby is, authorized to appoint Richard H.
Townley, now a lieutenant (junior grade) on the retired list of the Navy of the United States, to the grade and rank of lieutenant (junior grade) on the foot of the active list: *Provided*, That the said Richard H. Townley shall establish*Proviso.*—examination to the satisfaction of the Secretary of the Navy, by examination pursuant to law, his physical, mental, moral, and professional fitness to perform the duties of that grade.
