Brooke, United States Army,” approved March thirtieth, eighteen hundred and ninety-four.March 3, 1899. Whereas the legal representatives of John Smith failed to accept the Preamble. Vol. 28, p. 982. provisions of an Act entitled “An Act for the relief of Brigadier-General John R. Brooke, United States Army,” approved March thirtieth, eighteen hundred and ninety-four, within three months from the passage thereof, for the reason that neither the legal representatives nor the heirs of said John Smith had notice or knowledge of the passage of said Act, and were first informed thereof during the month of February, eighteen hundred and ninety-seven:
Therefore, *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,* That an Act entitled “An Act John Smith. Payment to legal representatives. for the relief of Brigadier-General John R. Brooke, United States Army,” approved March thirtieth, eighteen hundred and ninety-four, be, and the same is hereby, amended to read as follows:" “That the Secretary of the Treasury of the United States be authorized and directed to pay to the legal representatives of John Smith, late of New Mexico, the sum of one thousand dollars, being in full satisfaction of the judgment obtained by said John Smith in the district court of the first judicial district of the Territory of New Mexico, at the August term, eighteen hundred and sixty-nine, against Lieutenant-Colonel John R.
Brooke, Third Infantry, United States Army, now major-general, United States Army, for alleged trespass and false imprisonment: *Provided,* That the provisions of this Act shall be *Proviso.* To be accepted in full claims against Brig. Gen. John R. Brooke, U. S. A. accepted by the legal representatives of said John Smith as a settlement in full of all claims against John R. Brooke, of the United States Army, within three months from the passage hereof. And the said sum of one thousand dollars is hereby appropriated for said purpose, out of any money in the Treasury not otherwise appropriated, to be paid and received in full discharge and satisfaction of all claims arising out of said judgment.”" Approved, March 3, 1899.
