CHAP. 206.— An Act Authorizing the Purcell Bridge and Transfer Company to construct and maintain a bridge over the South Canadian River at or within one mile of the town of Lexington, county of Cleveland, Territory of Oklahoma.August 4, 1894. *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*,Purcell Bridge and Transfer Company mar bridge South Canadian River. Lexington, Okla. That the Furcell Bridge and Transfer Company, a corporation created under the laws of the Territory of Oklahoma by charter filed January fifteenth, anno Domini eighteen hundred and ninety-two, is authorized to construct and maintain a bridge, and approaches thereto, over the South Canadian River, at or within one mile of the town of Lexington, in the county of Cleveland, Territory of Oklahoma, to be used for the passage of foot passengers,Foot and wagon bridge. animals, and vehicles of all kinds, for reasonable rates of toils, to be approved from time to time by the Secretary of War.Tolls.Commencement and completion.
Sec. 2. That the right herein granted shall be void unless said bridge is commenced within one year and completed within three years from the passage of this act. Sec. 3. That the bridge constructed under this act shall be a lawfulLawful structure and post route. structure, and shall be known and recognized as a post route, and the same is hereby declared to be a post route upon which also no higher charge shall be made for the transmission over the same of the mails, the troops, and the munitions of war of the United States than other persons pay for like transportation; and the United States shall have thePostal telegraph.*Provisos.* right of way for the postal telegraph across said bridge: *Provided*, That before the construction of the bridge herein authorized is commenced the said company shall submit to the Secretary of War theSecretary of War to approve plans, etc. plans and specifications of said bridge, showing the proposed location 226 and structure contemplated, and that it shall be decided by the Secretary that said bridge does not and will not obstruct or impair the navigationAids to navigation. of said South Canadian River: *Provided also*, That said bridge shall, at all times, be so kept and managed as to offer reasonable and proper means for the passage of vessels and other water craft through or under said structure, and for the safety of vessels passing at night there shall be displayed on said bridge, from the hours of sunset to Lights, etc.Amendments, etc.sunrise, such lights or other signals as may be prescribed by the Light-House Board: *Provided further*, That Congress reserves the right to alter, amend, or repeal this act at any time; and that if at any time navigation of said river shall in any manner be obstructed or impaired by said bridge, the Secretary of War shall have authority, and it shall Changes.be his duty, to require the said company to alter and change the said bridge, at its own expense, in such manner as may be proper to secure free and complete navigation without impediment; and if upon reasonable notice to said company to make such change or improvements the said company fails to do so, the Secretary of War shall have authority to make the same at the expense of said company, and all rights conferred by this act shall be forfeited; and Congress shall have power to Free navigation.do any and all things necessary to secure the free navigation of said river.
