CHAP. 246.— An Act for the relief of John Hollins McBlair.February 19, 1891. Whereas John Hollins McBlair, late a first lieutenant in the FifteenthPreamble. United States Infantry, was, by order of the President dated October sixth, eighteen hundred and sixty-three, wholly retired from the service, and was afterwards, on April eighth, eighteen hundred and sixty-four, ordered by the President to be retired for disability incident to the service and to be placed upon the retired list, and has ever since been borne upon such retired list, up to November twelfth, eighteen hundred and eighty-four, and has been regularly paid as such retired officer lip to April thirtieth, eighteen hundred and eighty-four, and the Court of Claims has recently decided that the order of the President of April eighth, eighteen hundred and sixty-four, attempting to revoke the order of October sixth, eighteen hundred and sixty-three, wholly retiring him, and to restore him to the retired list, was not operative:
Therefore, *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled*John Hollins McBlair.May be appointed first lieutenant, retired., That the provisions of law regulating appointments in the Army by promotion in the line are hereby suspended for the purposes of this act only, and only 1364FIFTY-FIRST CONGRESS. Sess. II. Chs. 246, 247, 253. 1891. so far as they affect John Hollins McBlair; and the President can, if he so desire, in the exercise of his own discretion and judgment, nominate and, by and with the advice and consent of the Senate, appoint said John Hollins McBlair, late a first lieutenant in the Fifteenth United States Infantry Regiment, to the same grade and rank of first lieutenant in the Army of the United States in the infantry service, and to place him upon the retired list of the Army as of the Pay, etc.date of April eighth, eighteen hundred and sixty-four, with the pay of his grade and rank from April thirtieth, eighteen hundred and eighty-four, and with a full discharge from all liability for any sums paid to or received by him previously to said date.
