Chap. CCXLV.— An Act *relating to the Freedmen’s Bureau and providing for its Discontinuance.* July 25, 1868. *Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,* That the duties and powers of Powers, &c. of commissioner of bureau for re lief of freedmen, &c. to be discharged by whom. Vacancy, how filled. Army officer not to be detailed, unless, &c. Assistants, clerks, &c. how appointed. If vacancy in office of commissioner happens in recess of senate.commissioner of the bureau for the relief of freedmen and refugees shall continue to be discharged by the present commissioner of the bureau, and in case of vacancy in said office occurring by reason of his death or resig nation. the same shall be filled by appointment of the President on the nomination of the Secretary of War, and with the advice and consent of the Senate; and no officer of the army shall be detailed for service as commissioner or shall enter upon the duties of commissioner unless ap pointed by and with the advice and consent of the Senate; and all assist ant commissioners, agents, clerks, and assistants, shall be appointed by the Secretary of War on the nomination of the commissioner of the bureau.
In case of vacancy in the office of commissioner happening during the recess of the Senate, the duties of commissioner shall be dis charged by the acting assistant adjutant-general of the bureau until such vacancy can be filled. Sec. 2. *And be it further enacted,* That the commissioner of the Bureau to be withdrawn from the several States, January 1, 1869. Educational department, &c. continued.bureau shall, on the first day of January next, cause the said bureau to be withdrawn from the several States within which said bureau has acted and its operations shall be discontinued.
But the educational department of the said bureau and the collection and payment of moneys due the 194 FORTIETH CONGRESS. Sess. II. Ch. 245, 246. 1868.soldiers, sailors, and marines, or their heirs, shall be continued as now provided by law until otherwise ordered by act of Congress. The President of the United States having returned to the Senate, in which it originated, the bill entitled “An act relating to the Freedmen’s Bureau and providing for its Discontinuance,” with his objections thereto, the Senate proceeded, in pursuance of the Constitution, to reconsider the same; and *Resolved, * That the said bill do pass, two thirds of the Senate agreeing to pass the same.
Attest: GEO. C. GORHAM, *Secretary of the Senate.* In the House of Representatives, U. S., *July* 25*th,* 1868. The House of Representatives having proceeded, in pursuance of the Constitution, to reconsider the bill entitled “An act relating to the Freed men’s Bureau and providing for its Discontinuance,” returned to the Senate by the President of the United States, with his objections, and sent by the Senate to the House of Representatives, with the message of the President returning the bill— *Resolved, * That the bill do pass, two thirds of the House of Represent atives agreeing to pass the same.
