## SEC. 1810 ###
(a)Notwithstanding section 1101, the level for “Department of Health and Human Services, Health Resources and Services Administration, Health Resources and Services” shall be $6,274,790,000 of which:
(1)not more than $100,000,000 shall be available until expended for carrying out the provisions of Public Law 104-73 and for expenses incurred by the Department of Health and Human Services pertaining to administrative claims made under such law;
(2)$300,000,000 shall be for the program under title X of the Public Health Service Act (“PHS Act”) to provide for voluntary family planning projects;
(3)not less than $1,982,865,000 shall remain available through September 30, 2013 for parts A and B of title XXVI of the PHS Act, of which not less than $885,000,000 shall be for State AIDS Drug Assistance Programs under the authority of section 2616 or 311(c) of such Act; and
(4)no funds are provided for section 340G-1 of the PHS Act. ###
(b)The sixteenth, eighteenth, nineteenth, twenty-second, and twenty-fifth provisos under the heading “Department of Health and Human Services, Health Resources and Services Administration, Health Resources and Services” in division D of Public Law 111-117 shall not apply to funds appropriated by this division. ###
(c)Sections 747(c)(2), and 751(j)(2) of the PHS Act, and the proportional funding amounts in paragraphs
(1)through
(4)of section 756(e) of such Act shall not apply to funds made available by this division for “Department of Health and Human Services, Health Resources and Services Administration, Health Resources and Services”. ###
(d)For any program operating under section 751 of the PHS Act on or before January 1, 2009, the Secretary of Health and Human Services may waive any of the requirements contained in sections 751(d)(2)(A) and 751(d)(2)(B) of such Act. ###
(e)For purposes of this section, section 10503(d) of Public Law 111-148 shall be applied as if “, over the fiscal year 2008 level,” were stricken from such section.
