## SEC. 5105 HACKENSACK MEADOWLANDS AREA, NEW JERSEY Section 324 of the Water Resources Development Act of 1992 (106 Stat. 4849; 110 Stat. 3779) is amended— ####

(1)in subsection (a)— #####

(A)by striking “design” and inserting “planning, design,”; and #####

(B)by striking “Hackensack Meadowlands Development” and all that follows through “Plan for” and inserting “New Jersey Meadowlands Commission for the development of an environmental improvement program for”; ####

(2)in subsection (b)— #####

(A)in the subsection heading by striking “Required”; #####

(B)by striking “shall” and inserting “may”; #####

(C)by striking paragraph

(1)and inserting the following: > > #### “(1) > > Restoration and acquisitions of significant wetlands and aquatic habitat that contribute to the Meadowlands ecosystem.” > ; #####

(D)in paragraph

(2)by inserting “and aquatic habitat” before the period at the end; and #####

(E)by striking paragraph

(7)and inserting the following: > > #### “(7) > > Research, development, and implementation for a water quality improvement program, including restoration of hydrology and tidal flows and remediation of hot spots and other sources of contaminants that degrade existing or planned sites.” > ; ####

(3)in subsection (c)— #####

(A)by striking “non-Federal sponsor” and inserting “non-Federal interest”; and #####

(B)by inserting before the last sentence the following: “The non-Federal interest may also provide in-kind services not to exceed the non-Federal share of the total project cost.”; ####

(4)by redesignating subsection

(d)as subsection (e); ####

(5)by inserting after subsection

(c)the following: > > ### “(d) Credit > > The Secretary shall credit, in accordance with section 221 of the Flood Control Act of 1970 (42 U.S.C. 1962d–5b), toward the non-Federal share of the cost of a project to be carried out under the program developed under subsection

(a)the cost of design work carried out by the non-Federal interest for the project before the date of the partnership agreement for the project.” > ; and ####

(6)in subsection

(e)(as redesignated by paragraph

(4)of this subsection) by striking “$5,000,000” and inserting “$20,000,000”.
