## Sec. 643 reorganization ###
(a)Subject to subsection (b), the Secretary5 is authorized to establish, alter, consolidate or discontinue such organizational units or components within the Department as he may deem to be necessary or appropriate. Such authority shall not extend to the abolition of organizational units or components established by this Act, or to the transfer of functions vested by this Act in any organizational unit or component. 5Section 3159(b)(1) of the Floyd D. Spence National Defense Authorization Act for Fiscal Year 2001 (H.R. 5408 as introduced in the 106th Congress and enacted by section 1 of Public Law 106–398; 114 Stat. 1654A–469) attempted to amend subsection
(a)by striking “The Secretary” and inserting “(a) Except as provided in subsection (b), the Secretary”. The amendment could not be executed due to an earlier amendment by section 314(b)(1) of Public Law 106–377 (114 Stat. 1441A–79). ###
(b)The authority of the Secretary to establish, abolish, alter, consolidate, or discontinue any organizational unit or component of the National Nuclear Security Administration is governed by the provisions of section 3219 of the National Nuclear Security Administration Act (title XXXII of Public Law 106–65). ###
(c)The authority of the Secretary under subsection
(a)does not apply to the National Nuclear Security Administration. The corresponding authority that applies to the Administration is set forth in section 3212(e) of the National Nuclear Security Administration Act. **[**[42 U.S.C. 7253](/us/usc/t42/s7253)**]**
