## SEC. 9 DELAYS IN AN EMERGENCY **[**[12 U.S.C. 5008](/us/usc/t12/s5008)**]** A delay by a bank beyond the time limits prescribed or permitted by this Act shall be excused if the delay is caused by interruption of communication or computer facilities, suspension of payments by another bank, war, emergency conditions, failure of equipment, or other circumstances beyond the control of a bank and if the bank uses such diligence as the circumstances require.
