## SEC. 563 DETAILING OF APPELLATE DEFENSE COUNSEL Subsection
(b)of section 865 of title 10, United States Code (article 65 of the Uniform Code of Military Justice), is amended— ####
(1)in paragraph (1)— #####
(A)by striking “ the Judge Advocate General shall forward the record ” and inserting the following: > “the Judge Advocate General shall forward— > > > ##### “(A) > > the record” > ; #####
(B)in subparagraph (A), as designated by subparagraph
(A)of this paragraph, by striking the period and inserting “; and”; and #####
(C)by adding at the end the following new subparagraph: > > ##### “(B) > > a copy of the record of trial to an appellate defense counsel who shall be detailed to review the case and, upon request of the accused, to represent the accused before the Court of Criminal Appeals.” > ; and ####
(2)in paragraph (2)— #####

(i)in the matter preceding clause (i), by striking “shall” and inserting “shall, upon written request of the accused”; ######
(ii)in clause (i), by striking “, upon request of the accused,”; and ######

(i)by striking “accused” and all that follows through “waives” and inserting “accused waives”; ######
