## SEC. 212 MODIFICATION TO ANNUAL REPORT ON UNFUNDED PRIORITIES OF THE UNDER SECRETARY OF DEFENSE FOR RESEARCH AND ENGINEERING The second section 222e of title 10, United States Code, is amended— ####
(1)in subsection (a), by striking “the Secretary of Defense shall” and inserting “the Secretary of Defense, after coordinating with the Secretaries of the military departments, shall”; and ####
(2)in subsection (e)— #####
(A)in paragraph (1), by striking “and” at the end; #####
(B)in paragraph (2), by striking the period at the end and inserting “; and”; and #####
(C)by adding at the end the following new paragraph: > > #### “(3) > > in the case of a military construction project, has reached 35 percent design.” > .
