## SEC. 1108 TREATMENT OF VETERANS WHO DID NOT REGISTER FOR THE SELECTIVE SERVICE Section 3328 of title 5, United States Code, is amended by— ####
(1)in subsection (a)(1), by striking “(50 U.S.C. App. 453)” and inserting “(50 U.S.C. 3802)”; ####
(2)redesignating subsection
(b)as subsection (c); ####
(3)by inserting after subsection
(a)the following new subsection: > > ### “(b) > > Subsection
(a)shall not apply to an individual— > > > #### “(1) > > who is a veteran; > > > #### “(2) > > who provides evidence of active duty service to the Executive agency in which the individual seeks an appointment; and > > > #### “(3) > > for whom the requirement to register under section 3 of the Military Selective Service Act (50 U.S.C. 3802) has terminated or is now inapplicable due to age.” > ; and ####
(4)by adding at the end the following new subsection: > > ### “(d) > > In this section, the terms ‘**active duty**’ and ‘**veteran**’ have the meaning given those terms in section 101 of title 38.” > .
