## SEC. 1026 EXCEPTION TO PROHIBITION OF OVERHAUL, REPAIR, OR MAINTENANCE OF CERTAIN VESSELS IN SHIPYARDS OUTSIDE THE UNITED STATES OR GUAM Section 8680(a)(3) of title 10, United States Code, is amended— ####
(1)by redesignating subparagraphs
(A)and
(B)as clauses
(i)and (ii), respectively; ####
(2)by inserting “(A)” before “Notwithstanding”; ####
(3)by inserting “and subject to subparagraph (B)” after “paragraph (1)”; ####
(4)in clause (i), as so redesignated, by striking “or” at the end; ####
(5)in clause (ii), as so redesignated, by striking the period and inserting “; or”; ####
(6)by inserting after clause (ii), the following new clause: > > ###### “(iii) > > corrective and preventive maintenance of a deployed naval vessel planned to last not more than 21 days.” > ; and ####
(7)by inserting after subparagraph
(A)the following new subparagraph: > > ##### “(B) > > During any fiscal year, the cumulative work carried out under this paragraph for ships at any particular homeport may not exceed two percent of the average annual total workload of that homeport over the preceding three-year period, as measured in shipyard labor hours.” > .
