## SEC. 713 MODIFICATION OF ADMINISTRATION OF MEDICAL MALPRACTICE CLAIMS BY MEMBERS OF THE UNIFORMED SERVICES Section 2733a of title 10, United States Code, is amended— ####
(1)in subsection (a), by striking “subsection (f)” and inserting “subsection (g)”; ####
(2)in subsection (b)(6), by striking “subsection (f)” and inserting “subsection (g)”; ####
(3)in subsection (d)(1), by striking “subsection (f)” and inserting “subsection (g)”; ####
(4)by redesignating subsections
(f)through
(i)as subsections
(g)through (j), respectively; and ####
(5)by inserting after subsection
(e)the following new subsection (f): > > ### “(f) Justification of Denial > > If a claim under this section is denied, the Secretary of Defense shall provide the claimant with detailed reasoning justifying the denial of the claim, including— > > > #### “(1) > > copies of any written reports prepared by any expert upon which the denial is based; and > > > #### “(2) > > all records and documents relied upon in preparing such written reports, other than medical quality assurance records (as such term is defined in section 1102 of this title).” > .
