## SEC. 5501 AMENDMENTS TO THE ENERGY EMPLOYEES OCCUPATIONAL ILLNESS COMPENSATION PROGRAM ACT OF 2000 ###
(a)Short Title **[**[42 U.S.C. 7384 note](/us/usc/t42/s7384)**]** This section may be cited as the “Beryllium Testing Fairness Act”. ###
(b)Modification of Demonstration of Beryllium Sensitivity Section 3621(8)(A) of the Energy Employees Occupational Illness Compensation Program Act of 2000 (42 U.S.C. 7384l(8)(A)) is amended— ####
(1)by striking “ established by an abnormal ” and inserting the following: > “established by— > > > ###### “(i) > > an abnormal” > ; ####
(2)by striking the period at the end and inserting “; or”; and ####
(3)by adding at the end the following: > > ### “(ii) > > three borderline beryllium lymphocyte proliferation tests performed on blood cells over a period of 3 years.” > . ###
(c)Extension of Advisory Board on Toxic Substances and Worker Health Section 3687(j) of the Energy Employees Occupational Illness Compensation Program Act of 2000 (42 U.S.C. 7385s-16(j)) is amended by striking “10 years” and inserting “15 years”. # TITLE LVI TRANSPORTATION AND INFRASTRUCTURE MATTERS
