## SEC. 613 TEMPORARY CONTINUATION OF RATE OF BASIC ALLOWANCE FOR HOUSING FOR MEMBERS OF THE ARMED FORCES WHOSE SOLE DEPENDENT DIES WHILE RESIDING WITH THE MEMBER ###
(a)Authority Section 403 of title 37, United States Code, as amended by section 612, is further amended— ####
(1)by redesignating subsections
(m)through
(p)as subsections
(n)through (q); and ####
(2)by inserting after subsection
(l)the following new subsection (m): > > ### “(m) Temporary Continuation of Rate of Basic Allowance for Members of the Armed Forces Whose Sole Dependent Dies While Residing With the Member > > > ####
(1)> > Notwithstanding subsection (a)(2) or any other section of law, the Secretary of Defense or the Secretary of the Department in which the Coast Guard is operating, may, after the death of the sole dependent of a member of the armed forces, continue to pay a basic allowance for housing to such member at the rate paid to such member on the date of such death if— > > > ##### “(A) > > such sole dependent dies— > > > ###### “(i) > > while the member is on active duty; and > > > ###### “(ii) > > while residing with the member, unless separated by the necessity of military service or to receive institutional care as a result of disability or incapacitation or under such other circumstances as the Secretary concerned may by regulation prescribe; and > > > ##### “(B) > > the member is not occupying a housing facility under the jurisdiction of the Secretary concerned on the date of the death of the sole dependent. > > > #### “(2) > > The continuation of the rate of an allowance under this subsection shall terminate upon the earlier of the following to occur: > > > ##### “(A) > > The day that is one year after the date of the death of the sole dependent. > > > ##### “(B) > > The permanent change of station, or permanent change of assignment with movement of personal property and household goods under section 453(c) of this title, of the member.” > . ###
(b)Conforming Amendment Section 2881a(c) of title 10, United States Code, is amended by striking “section 403(n)” and inserting “section 403(o)”.
