## SEC. 2809 USE OF OPERATION AND MAINTENANCE FUNDS FOR CERTAIN CONSTRUCTION PROJECTS OUTSIDE THE UNITED STATES ###
(a)Permanent Authority **[**[10 U.S.C. 2804 note](/us/usc/t10/s2804)**]** Section 2808 of the Military Construction Authorization Act for Fiscal Year 2004 (division B of Public Law 108-136; 117 Stat. 1723), as most recently amended by section 2806 of the Military Construction Authorization Act for Fiscal Year 2022 (division B of Public Law 117-81; 135 Stat. 2190), is further amended— ####
(1)in subsection (a)— #####
(A)by striking “, inside the area of responsibility of the United States Central Command or certain countries in the area of responsibility of the United States Africa Command,”; #####
(B)by inserting “outside the United States” after “construction project”; and #####
(C)in paragraph (2), by striking “, unless the military installation is located in Afghanistan, for which projects using this authority may be carried out at installations deemed as supporting a long-term presence”; and ####
(2)in subsection (c)(1), by striking subparagraph
(A)and redesignating subparagraphs
(B)and
(C)as subparagraphs
(A)and (B), respectively. ###
(b)Conforming Amendments Such section is further amended— ####
(1)in subsection (b), by striking “subsection (f)” and inserting “subsection (d)”; ####
(2)**[**[10 U.S.C. 2805 note](/us/usc/t10/s2805)**]** by striking subsection (e); ####
(3)**[**[10 U.S.C. 2804 note](/us/usc/t10/s2804)**]** by redesignating subsections
(f)and
(g)as subsections
(d)and (e), respectively; ####
(4)in subsection (e), as so redesignated, by striking “subsection (f)” and inserting “subsection (d)”; and ####
(5)by striking subsections
(h)and (i). ###
(c)Clerical Amendments Such section is further amended as follows: ####
(1)The section heading for such section is amended— #####
(A)by striking “temporary, limited authority” and inserting “authority” ; and #####
(B)by inserting “certain” before “construction projects”. ####
(2)The subsection heading for subsection
(a)of such section is amended by striking “Temporary Authority” and inserting “In General”. ###
(d)Classification **[**[10 U.S.C. 2804 note](/us/usc/t10/s2804)**]** The Law Revision Counsel is directed to classify section 2808 of the Military Construction Authorization Act for Fiscal Year 2004 (division B of Public Law 108-136; 117 Stat. 1723), as amended by subsection (a), as a note following section 2804 of title 10, United States Code.
