## SEC. 11705 RETIREMENT AND SEPARATION ###
(a)Involuntary Retirement or Separation Section 241(a)(1) of the National Oceanic and Atmospheric Administration Commissioned Officer Corps Act of 2002 (33 U.S.C. 3041(a)(1)) is amended to read as follows: > > #### “(1) > > an officer in the permanent grade of captain or commander may— > > > ##### “(A) > > except as provided by subparagraph (B), be transferred to the retired list; or > > > ##### “(B) > > if the officer is not qualified for retirement, be separated from service; and” > . ###
(b)Retirement for Age Section 243(a) of that Act (33 U.S.C. 3043(a)) is amended by striking “be retired” and inserting “be retired or separated (as specified in section 1251(e) of title 10, United States Code)”. ###
(c)Retirement or Separation Based on Years of Creditable Service Section 261(a) of that Act (33 U.S.C. 3071(a)) is amended— ####
(1)by redesignating paragraphs
(17)through
(26)as paragraphs
(18)through (27), respectively; and ####
(2)by inserting after paragraph
(16)the following: > > #### “(17) > > Section 1251(e), relating to retirement or separation based on years of creditable service.” > .
