## SEC. 8012 ###
(a)During the current fiscal year, the civilian personnel of the Department of Defense may not be managed on the basis of any constraint or limitation in terms of man years, end strength, full-time equivalent positions, or maximum number of employees, but are to be managed solely on the basis of, and in a manner consistent with— ####
(1)the total force management policies and procedures established under section 129a of title 10, United States Code; ####
(2)the workload required to carry out the functions and activities of the Department; and ####
(3)the funds made available to the Department for such fiscal year. ###
(b)None of the funds appropriated by this Act may be used to reduce the civilian workforce programmed full time equivalent levels absent the appropriate analysis of the impacts of these reductions on workload, military force structure, lethality, readiness, operational effectiveness, stress on the military force, and fully burdened costs. ###
(c)A projection of the number of full-time equivalent positions shall not be considered a constraint or limitation for purposes of subsection
(a)and reducing funding for under-execution of such a projection shall not be considered managing based on a constraint or limitation for purposes of such subsection. ###
(d)The fiscal year 2023 budget request for the Department of Defense, and any justification material and other documentation supporting such request, shall be prepared and submitted to Congress as if subsections
(a)and
(b)were effective with respect to such fiscal year. ###
(e)Nothing in this section shall be construed to apply to military (civilian) technicians.
