## SEC. 1053 SALE OR DONATION OF EXCESS DEPARTMENT OF DEFENSE PERSONAL PROPERTY FOR LAW ENFORCEMENT ACTIVITIES ###
(a)Inclusion of Disaster-related Emergency Preparedness Activities Among Law Enforcement Activities Authorities ####
(1)Inclusion Subsection (a)(1)(A) of section 2576a of title 10, United States Code, is amended by inserting “disaster-related emergency preparedness,” after “counterterrorism,”. ####
(2)Preference in transfers Subsection
(d)of such section is amended to read as follows: > > ### “(d) Preference for Certain Transfers > > In considering applications for the transfer of personal property under this section, the Secretary shall give a preference to applications indicating that the transferred property will be used in the counterdrug, counterterrorism, disaster-related emergency preparedness, or border security activities of the recipient agency. Applications that request vehicles used for disaster-related emergency preparedness, such as high-water rescue vehicles, should receive the highest preference.” > . ###
(b)Additional Conditions and Limitations ####
(1)Additional training of recipient agency personnel required Subsection (b)(6) of section 2576a of title 10, United States Code, is amended by inserting before the period at the end the following: “, including respect for the rights of citizens under the Constitution of the United States and de-escalation of force”. ####
(2)Certain property not transferrable Such section is further amended— #####
(A)by redesignating subsections
(e)and
(f)as subsections
(f)and (g), respectively; and #####
(B)by inserting after subsection
(d)the following new subsection (e): > > ### “(e) Property Not Transferrable > > The Secretary may not transfer to a Tribal, State, or local law enforcement agency under this section the following: > > > #### “(1) > > Bayonets. > > > #### “(2) > > Grenades (other than stun and flash-bang grenades). > > > #### “(3) > > Weaponized tracked combat vehicles. > > > #### “(4) > > Weaponized drones.” > .
