## SEC. 1021 LIMITATION ON AVAILABILITY OF CERTAIN FUNDS WITHOUT NAVAL VESSELS PLAN AND CERTIFICATION Section 231 of title 10, United States Code, is amended— ####
(1)in subsection (a)— #####
(A)by striking “Secretary of Defense” and inserting “Secretary of the Navy”; and #####
(B)by striking “and” after the colon; and ####
(2)in subsection (e)— #####
(A)in paragraph (1), by striking “the Secretary of the Navy may not use more than 50 percent of the funds” and inserting “the Secretary of Defense may not use more than 25 percent of the funds”; and #####
(B)in paragraph (2)— ######
(i)by striking “Secretary of the Navy” and inserting “Secretary of Defense”; ######
(ii)by striking “operation and maintenance, Navy” and inserting “operation and maintenance, Defense-wide”; and ######
(iii)by inserting before the period at the end the following: “, that remain available for obligation or expenditure as of the date on which the plan and certification under subsection
(a)are required to be submitted”.
