## SEC. 1108 PANDEMIC EBT PROGRAM Section 1101 of the Families First Coronavirus Response Act (7 U.S.C. 2011 note; Public Law 116-127) is amended— ####
(1)in subsection (a)— #####
(A)by striking “During fiscal years 2020 and 2021” and inserting “In any school year in which there is a public health emergency designation”; and #####
(B)by inserting “or in a covered summer period following a school session” after “in session”; ####
(2)in subsection (g), by striking “During fiscal year 2020, the” and inserting “The”; ####
(3)in subsection (h)(1)— #####
(A)by inserting “either” after “at least 1 child enrolled in such a covered child care facility and”; and #####
(B)by inserting “or a Department of Agriculture grant-funded nutrition assistance program in the Commonwealth of the Northern Mariana Islands, Puerto Rico, or American Samoa” before “shall be eligible to receive assistance”; ####
(4)by redesignating subsections
(i)and
(j)as subsections
(j)and (k), respectively; ####
(5)by inserting after subsection
(h)the following: > > ###### “(i) Emergencies During Summer > > The Secretary of Agriculture may permit a State agency to extend a State agency plan approved under subsection
(b)for not more than 90 days for the purpose of operating the plan during a covered summer period, during which time schools participating in the school lunch program under the Richard B. Russell National School Lunch Act or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (42 U.S.C. 1773 ) and covered child care facilities shall be deemed closed for purposes of this section.” > ; ####
