## SEC. 5721 WHISTLEBLOWER DISCLOSURES TO CONGRESS AND COMMITTEES OF CONGRESS Section 2302 of title 5, United States Code, is amended— ####
(1)in subsection (b)(8)— #####
(A)in subparagraph (A), by striking “; or” and inserting a semicolon; #####
(B)in subparagraph (B)(ii), by striking the semicolon at the end and inserting “; or”; and #####
(C)by inserting after subparagraph
(B)the following new subparagraph: > > ##### “(C) > > any disclosure to Congress (including any committee of Congress) by any employee of an agency or applicant for employment at an agency of information described in subparagraph
(B)that is— > > > ###### “(i) > > not classified; or > > > ###### “(ii) > > if classified— > > > ###### “(I) > > has been classified by the head of an agency that is not an element of the intelligence community (as defined by section 3 of the National Security Act of 1947 (50 U.S.C. 3003)); and > > > ###### “(II) > > does not reveal intelligence sources and methods.” > ; and ####
(2)in subsection (c)(2)(C)(iii)(III), by inserting after “Congress” the following: “(including any committee of Congress 133 STAT. 2176 with respect to information that is not classified or, if classified, has been classified by the head of an agency that is not an element of the intelligence community and does not reveal intelligence sources and methods)”.
