## SEC. 1681 NATIONAL MISSILE DEFENSE POLICY ###
(a)Policy Subsection
(a)of section 1681 of the National Defense Authorization Act for Fiscal Year 2017 (Public Law 114-328; 10 U.S.C. 2431 note) is amended to read as follows: > > ### “(a) Policy > > It is the policy of the United States to— > > > #### “(1) > > maintain and improve, with funding subject to the annual authorization of appropriations and the annual appropriation of funds for National Missile Defense— > > > ##### “(A) > > an effective, layered missile defense system capable of defending the territory of the United States against the developing and increasingly complex missile threat posed by rogue states; and > > > ##### “(B) > > an effective regional missile defense system capable of defending the allies, partners, and deployed forces of the United States against increasingly complex missile threats; and > > > #### “(2) > > rely on nuclear deterrence to address more sophisticated and larger quantity near-peer intercontinental missile threats to the homeland of the United States.” > . ###
(b)Redesignation Requirement **[**[10 U.S.C. 2431 note](/us/usc/t10/s2431)**]** Not later than the date on which the President submits to Congress the annual budget request of the President for fiscal year 2021 pursuant to section 1105 of title 31, United States Code, the Secretary of Defense shall, as the Secretary considers appropriate, redesignate all strategies, policies, programs, and systems under the jurisdiction of the Secretary to reflect that missile defense programs of the United States defend against ballistic, cruise, and hypersonic missiles in all phases of flight.
