## SEC. 1632 NOTIFICATION REQUIREMENTS FOR SENSITIVE MILITARY CYBER OPERATIONS Section 395 of title 10, United States Code, is amended— ####
(1)in subsection (b)(3), by inserting “, signed by the Secretary, or the Secretary’s designee,” after “written notification”; and ####
(2)in subsection (c)— #####
(A)in paragraph (1)— ######
(i)in subparagraph (A), by striking “and” after the semicolon at the end; ######
(ii)by redesignating subparagraph
(B)as subparagraph (C); and ######
(iii)by inserting after subparagraph
(A)the following new subparagraph: > > ##### “(B) > > is determined to— > > > ###### “(i) > > have a medium or high collateral effects estimate; > > > ###### “(ii) > > have a medium or high intelligence gain or loss; > > > ###### “(iii) > > have a medium or high probability of political retaliation, as determined by the political military assessment contained within the associated concept of operations; > > > ###### “(iv) > > have a medium or high probability of detection when detection is not intended; or > > > ###### “(v) > > result in medium or high collateral effects; and” > ; and #####
(B)in paragraph (2)(B), by striking “outside the Department of Defense Information Networks to defeat an ongoing or imminent threat”.
