## SEC. 148 LIMITATION ON AVAILABILITY OF FUNDS FOR RETIREMENT OF RC-135 AIRCRAFT ###
(a)Limitation Except as provided in subsection (b), none of the funds authorized to be appropriated by this Act or otherwise made available for fiscal year 2020, or for fiscal year 2021, for the Air Force may be obligated or expended to retire, or prepare to retire, any RC-135 aircraft until a period of 60 days has elapsed following the date on which the Secretary of Defense certifies to the congressional defense committees that— ####
(1)technologies other than the RC-135 aircraft provide capacity and capabilities equivalent to the capacity and capabilities of the RC-135 aircraft; and ####
(2)the capacity and capabilities of such other technologies meet the requirements of combatant commanders with respect to indications and warning, intelligence preparation of the operational environment, and direct support for kinetic and nonkinetic operations. ###
(b)Exception The limitation in subsection
(a)shall not apply to individual RC-135 aircraft that the Secretary of the Air Force determines, on a case-by-case basis, to be no longer mission capable because of mishaps, other damage, or being uneconomical to repair.
