## SEC. 126 MODIFICATION OF PROHIBITION ON AVAILABILITY OF FUNDS FOR NAVY WATERBORNE SECURITY BARRIERS Section 130 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Public Law 115-232)is amended— ####
(1)in subsection
(a)by striking “for fiscal year 2019 may be obligated or expended to procure legacy waterborne security barriers for Navy ports” and inserting “for fiscal year 2019 or fiscal year 2020 may be obligated or expended to procure legacy waterborne security barriers for Navy ports, including as replacements for legacy barriers”; ####
(2)in subsection (c)(1), by inserting “of not more than 30 percent” after “replacement”; and ####
(3)by adding at the end the following new subsection: > > ### “(d) Notification > > Not later than 15 days after an exception is made pursuant to subsection (c)(2), the Secretary of the Navy shall submit a written notification to the congressional defense committees that includes— > > > #### “(1) > > the name and position of the government official who determined exigent circumstances exist; > > > #### “(2) > > a description of the exigent circumstances; and > > > #### “(3) > > a description of how waterborne security will be maintained until new waterborne security barriers are procured and installed.” > .
