## SEC. 311 ###
(a)In General For the purpose of carrying out 34 CFR §668.206(a)(1), the Secretary of Education may waive the requirements under 34 CFR §668.213(b)(1) for an institution of higher education that offers an associate degree, is a public institution, and is located in an economically distressed county, defined as a county with a poverty rate of at least 25 percent based on the U.S. Census Bureau’s Small Area Income and Poverty Estimate program data for 2017 that was impacted by Hurricane Matthew. ###
(b)Applicability Subsection
(a)shall apply to an institution of higher education that otherwise would be ineligible to participate in a program under part D of title IV of the Higher Education Act of 1965 on or after the date of enactment of this Act due to the application of 34 CFR §668.206(a)(1). ###
(c)Coverage This section shall be in effect for the period covered by this Act and for the succeeding fiscal year.
