## SEC. 3104 SPECIAL RULE FOR CERTAIN EMPLOYERS **[**[29 U.S.C. 2620 note](/us/usc/t29/s2620)**]** An employer under section 110(a)(1)(B) of the Family and Medical Leave Act of 1993 shall not be subject to section 107(a) of such Act for a violation of section 102(a)(1)(F) of such Act if the employer does not meet the definition of employer set forth in section 101(4)(A)(i) of such Act.
