## SEC. 316 EXTENSION OF AUTHORIZED PERIODS OF PERMITTED INCIDENTAL TAKINGS OF MARINE MAMMALS IN THE COURSE OF SPECIFIED ACTIVITIES BY DEPARTMENT OF DEFENSE Section 101(a)(5)(A) of the Marine Mammal Protection Act of 1972 (16 U.S.C. 1371(a)(5)(A)) is amended— ####
(1)in clause (i), by striking “Upon request” and inserting “Except as provided by clause (ii), upon request”; ####
(2)by redesignating clauses
(ii)and
(iii)as clauses
(iii)and (iv), respectively; and ####
(3)by inserting after clause
(i)the following new clause (ii): > > ###### “(ii) > > In the case of a military readiness activity (as defined in section 315(f) of the Bob Stump National Defense Authorization Act for Fiscal Year 2003 (Public Law 107-314; 16 U.S.C. 703 note), clause
(i)shall be applied— > > > ###### “(I) > > in the matter preceding clause (I), by substituting ‘seven consecutive years’ for ‘five consecutive years’; and > > > ###### “(II) > > in clause (I), by substituting ‘seven-year’ for ‘five-year’.” > .
