## SEC. 1716 CONSIDERATIONS FOR REGULATIONS Section 721(h) of the Defense Production Act of 1950 (50 U.S.C. 4565(h)) is amended— ####
(1)by striking paragraph (2); ####
(2)by redesignating paragraph
(3)as paragraph (2); and ####
(3)in paragraph (2), as redesignated— #####
(A)in subparagraph (A), by striking “including any mitigation” and all that follows through “subsection (l)” and inserting “including any mitigation agreement entered into, conditions imposed, or order issued pursuant to this section”; #####
(B)in subparagraph (B)(ii), by striking “and” at the end; #####
(C)in subparagraph (C), by striking the period at the end and inserting “; and”; and #####
(D)by adding at the end the following: > > ##### “(D) > > provide that, in any review or investigation of a covered transaction conducted by the Committee under subsection (b), the Committee should— > > > ###### “(i) > > consider the factors specified in subsection (f); and > > > ###### “(ii) > > as appropriate, require parties to provide to the Committee the information necessary to consider such factors.” > .
