## SEC. 429 treatment of certain hospitals Section 1886(d)(12)(C) of the Social Security Act (42 U.S.C. 1395ww(d)(12)(C)) is amended by adding at the end the following new clause: > > ###### “(iii) Treatment of indian health service and non-indian health service facilities > > For purposes of determining whether— > > > ###### “(I) > > a subsection
(d)hospital of the Indian Health Service (whether operated by such Service or by an Indian tribe or tribal organization (as those terms are defined in section 4 of the Indian Health Care Improvement Act)), or > > > ###### “(II) > > a subsection
(d)hospital other than a hospital of the Indian Health Service meets the mileage criterion under clause
(i)with respect to fiscal year 2011 or a succeeding fiscal year, the Secretary shall apply the policy described in the regulation at part 412.101(e) of title 42, Code of Federal Regulations (as in effect on the date of enactment of this clause).” > .
