## SEC. 2208 CONTRACTS ###
(a)Transition Option for Certain Farmers or Ranchers Section 1235(f) of the Food Security Act of 1985 (16 U.S.C. 3835(f)) is amended— ####
(1)in paragraph (1)— #####
(A)in the matter preceding subparagraph (A), by striking “retired farmer or rancher” and inserting “contract holder”; #####
(B)by striking “retired or retiring owner or operator” each place it appears and inserting “contract holder”; #####
(C)in subparagraph (A), in the matter preceding clause (i), by striking “1 year” and inserting “2 years”; #####
(D)in subparagraph (B), by inserting “, including a lease with a term of less than 5 years and an option to purchase” after “option to purchase”; #####
(E)in subparagraph (D), by striking “; and” and inserting a semicolon; #####
(F)by redesignating subparagraph
(E)as subparagraph (F); and #####
(G)by inserting after subparagraph
(D)the following: > > ##### “(E) > > give priority to the enrollment of the land covered by the contract in— > > > ###### “(i) > > the environmental quality incentives program established under subchapter A of chapter 4; > > > ###### “(ii) > > the conservation stewardship program established under subchapter B of chapter 4; or > > > ###### “(iii) > > the agricultural conservation easement program established under subtitle H; and” > ; and ####

(A)in the matter preceding subparagraph (A), by striking “The Secretary” and inserting “To the extent that the maximum number of acres permitted to be enrolled under the conservation reserve program has not been met, the Secretary”; and #####

(b)End of Contract Considerations Section 1235(g) of the Food Security Act of 1985 (16 U.S.C. 3835(g)) is amended to read as follows: > > ### “(g) End of Contract Considerations > > The Secretary shall not consider an owner or operator to be in violation of a term or condition of the conservation reserve contract if— > > > #### “(1) > > during the year prior to expiration of the contract, the owner or operator— > > > ##### “(A) > > > ######
(i)> > enters into a contract under the environmental quality incentives program established under subchapter A of chapter 4; and > > > ###### “(ii) > > begins the establishment of a practice under that contract; or > > > ##### “(B) > > > ######
(i)> > enters into a contract under the conservation stewardship program established under subchapter B of chapter 4; and > > > ###### “(ii) > > begins the establishment of a practice under that contract; or > > > #### “(2) > > during the 3 years prior to the expiration of the contract, the owner or operator begins the certification process under the Organic Foods Production Act of 1990 (7 U.S.C. 6501 et seq.).” > .
