## SEC. 50745 CRIMINAL RECORDS CHECKS AND CHECKS OF CHILD ABUSE AND NEGLECT REGISTRIES FOR ADULTS WORKING IN CHILD-CARE INSTITUTIONS AND OTHER GROUP CARE SETTINGS ###
(a)State Plan Requirement Section 471(a)(20) of the Social Security Act (42 U.S.C. 671(a)(20)) is amended— ####
(1)in subparagraph (A)(ii), by striking “and” after the semicolon; ####
(2)in subparagraph (B)(iii), by striking “and”after the semicolon; ####
(3)in subparagraph (C), by adding “and” after the semicolon; and ####
(4)by inserting after subparagraph (C), the following new subparagraph: > > ##### “(D) > > provides procedures for any child-care institution, including a group home, residential treatment center, shelter, or other congregate care setting, to conduct criminal records checks, including fingerprint-based checks of national crime information databases (as defined in section 534(f)(3)(A) of title 28, United States Code), and checks described in subparagraph
(B)of this paragraph, on any adult working in a child-care institution, including a group home, residential treatment center, shelter, or other congregate care setting, unless the State reports to the Secretary the alternative criminal records checks and child abuse registry checks the State conducts on any adult working in a child-care institution, including a group home, residential treatment center, shelter, or other congregate care setting, and why the checks specified in this subparagraph are not appropriate for the State;” > . ###
(b)Technical Amendments Subparagraphs
(A)and
(C)of section 471(a)(20) of the Social Security Act (42 U.S.C. 671(a)(20)) are each amended by striking “section 534(e)(3)(A)” and inserting “section 534(f)(3)(A)”.
