## SEC. 105 CLARIFICATION REGARDING AUTHORITY FOR FLEXIBLE PERSONNEL MANAGEMENT AMONG ELEMENTS OF INTELLIGENCE COMMUNITY ###
(a)Clarification Section 102A(v) of the National Security Act of 1947 (50 U.S.C. 3024(v)) is amended— ####
(1)by redesignating paragraph
(3)as paragraph (4); and ####
(2)by inserting after paragraph
(2)the following new paragraph (3): > > #### “(3) > > A covered department may appoint an individual to a position converted or established pursuant to this subsection without regard to the civil-service laws, including parts II and III of title 5, United States Code.” > . ###
(b)Effective Date **[**[50 U.S.C. 3024 note](/us/usc/t50/s3024)**]** The amendments made by subsection
(a)shall apply with respect to an appointment under section 102A(v) of the National Security Act of 1947 (50 U.S.C. 3024(v)) made on or after the date of the enactment of the Intelligence Authorization Act for Fiscal Year 2012 (Public Law 112-87) and to any proceeding pending on or filed after the date of the enactment of this section that relates to such an appointment. # Title II CENTRAL INTELLIGENCE AGENCY RETIREMENT AND DISABILITY SYSTEM
