## SEC. 504 PROMOTION ELIGIBILITY PERIOD FOR OFFICERS WHOSE CONFIRMATION OF APPOINTMENT IS DELAYED DUE TO NONAVAILABILITY TO THE SENATE OF PROBATIVE INFORMATION UNDER CONTROL OF NON-DEPARTMENT OF DEFENSE AGENCIES Section 629(c) of title 10, United States Code, is amended— ####
(1)by redesignating paragraph
(3)as paragraph (4); and ####
(2)by inserting after paragraph
(2)the following new paragraph (3): > > #### “(3) > > Paragraph
(1)does not apply when the Senate is not able to obtain information necessary to give its advice and consent to the appointment concerned because that information is under the control of a department or agency of the Federal Government other than the Department of Defense.” > .
