## SEC. 217 INCREASED MICRO-PURCHASE THRESHOLD FOR RESEARCH PROGRAMS AND ENTITIES ###
(a)Increased Micro-purchase Threshold for Basic Research Programs and Activities of the Department of Defense Science and Technology Reinvention Laboratories ####
(1)In general Chapter 137 of title 10, United States Code, as amended by section 821(a), is further amended by adding at the end the following new section: > > ## “SEC. 2339 Micro-purchase threshold for basic research programs and activities of the Department of Defense science and technology reinvention laboratories > > **[**[10 U.S.C. 2339](/us/usc/t10/s2339)**]** > > “Notwithstanding subsection
(a)of section 1902 of title 41, the micro-purchase threshold for the Department of Defense for purposes of such section is $10,000 for purposes of basic research programs and for the activities of the Department of Defense science and technology reinvention laboratories.” > . ####
(2)Clerical amendment **[**[10 U.S.C. 2301](/us/usc/t10/s2301)**]** The table of sections at the beginning of such chapter, as amended by section 821(b), is further amended by adding at the end the following new item:" “2339. Micro-purchase threshold for basic research programs and activities of the Department of Defense science and technology reinvention laboratories.” ". ###
(b)Increased Micro-purchase Threshold for Universities, Independent Research Institutes, and Nonprofit Research Organizations Section 1902 of title 41, United States Code, is amended— ####
(1)in subsection (a)— #####
(A)by striking “For purposes” and inserting “(1) Except as provided in sections 2338 and 2339 of title 10 and paragraph
(2)of this subsection, for purposes”; and #####
(B)by adding at the end the following new paragraph: > > #### “(2) > > For purposes of this section, the micro-purchase threshold for procurement activities administered under sections 6303 through 6305 of title 31 by institutions of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a)), or related or affiliated nonprofit entities, or by nonprofit research organizations or independent research institutes is— > > > ##### “(A) > > $10,000; or > > > ##### “(B) > > such higher threshold as determined appropriate by the head of the relevant executive agency and consistent with clean audit findings under chapter 75 of title 31, internal institutional risk assessment, or State law.” > ; and ####
(2)in subsections
(d)and (e), by striking “not greater than $3,000” and inserting “with a price not greater than the micro-purchase threshold”.
