## SEC. 212 MODIFICATION OF MECHANISMS TO PROVIDE FUNDS FOR DEFENSE LABORATORIES FOR RESEARCH AND DEVELOPMENT OF TECHNOLOGIES FOR MILITARY MISSIONS ###
(a)Amount Authorized Under Current Mechanism Paragraph
(1)of subsection
(a)of section 219 of the Duncan Hunter National Defense Authorization Act for Fiscal Year 2009 (10 U.S.C. 2358 note) is amended in the matter before subparagraph
(A)by striking “not more than three percent” and inserting “not less than two percent and not more than four percent”. ###
(b)Additional Mechanism to Provide Funds Such subsection is further amended by adding at the end the following new paragraph: > > #### “(3) Fee > > After consultation with the science and technology executive of the military department concerned, the director of a defense laboratory may charge customer activities a fixed percentage fee, in addition to normal costs of performance, in order to obtain funds to carry out activities authorized by this subsection. The fixed fee may not exceed four percent of costs.” > . ###
(c)Modification of Cost Limit Compliance for Infrastructure Projects Subsection (b)(4) of such section is amended by adding at the end the following new subparagraph: > > ##### “(C) > > Section 2802 of such title, with respect to construction projects that exceed the cost specified in subsection (a)(2) of section 2805 of such title for certain unspecified minor military construction projects for laboratories.” > . ###
(d)Repeal of Sunset Such section is amended by striking subsection (d).
