## SEC. 2302 USE OF REVENUES AT PREVIOUSLY ASSOCIATED AIRPORT Section 40117 of title 49, United States Code, is amended by adding at the end the following: > > ### “(n) Use of Revenues at Previously Associated Airport > > Notwithstanding the requirements relating to airport control under subsection (b)(1), the Secretary may authorize use of a passenger facility charge under subsection
(b)to finance an eligible airport-related project if— > > > #### “(1) > > the eligible agency seeking to impose the new charge controls an airport where a $2.00 passenger facility charge became effective on January 1, 2013; and > > > #### “(2) > > the location of the project to be financed by the new charge is at an airport that was under the control of the same eligible agency that had controlled the airport described in paragraph (1).” > .
