## SEC. 41010 APPLICATION **[**[42 U.S.C. 4370m-9](/us/usc/t42/s4370m-9)**]** This title applies to any covered project for which— ####

(1)a notice is filed under section 41003(a)(1); or ####

(2)an application or other request for a Federal authorization is pending before a Federal agency 90 days after the date of enactment of this Act.
