## SEC. 2002 AVAILABILITY PAYMENT CONCESSION MODEL ###

(a)Payment to States for Construction Section 121(a) of title 23, United States Code, is amended by inserting “(including payments made pursuant to a long-term concession agreement, such as availability payments)” after “a project”. ###

(b)Project Approval and Oversight Section 106(b)(1) of title 23, United States Code, is amended by inserting “(including payments made pursuant to a long-term concession agreement, such as availability payments)” after “construction of the project”. # TITLE III PUBLIC TRANSPORTATION
